Anveshan, Auroville Foundation (henceforth "Anveshan") provides the products and services outlined herein. These Usage Terms and Conditions (collectively referred to as "Terms") govern your ("the Client", "you", "your") interaction with and utilization of Anveshan's online platform at http://www.anveshan.auroville.org/ and other offerings, including retreats, yatras, and customized journeys ("Services"). We urge you to review these Terms thoroughly and direct any queries to anveshan@auroville.org.in. By engaging with our Services, you acknowledge and consent to these Terms. Should you disagree with any aspect of the Terms, we advise refraining from accessing or using the Services or the website.

Engagement with Services

Eligible Clients
The Services are accessible exclusively to Clients who have reached the age of legal maturity and can enter into binding legal agreements under applicable statutes. Individuals under 18 years of age are prohibited from use or access. Clients below 18 years may only engage with the Services under the supervision and with the consent of a parent or legal guardian, provided said guardian agrees to be bound by the Terms and provides consent on the minor's behalf where required. Anveshan maintains the right to deny access to the Services to any potential clients at its discretion, without providing justification.

Restricted Authorization

  1. All content displayed or featured on this website and materials furnished by Anveshan on this platform or otherwise ("Material") is the property of Anveshan, its licensors and/or its content suppliers. Every element of the website and materials provided by Anveshan, including but not limited to design and Material, is safeguarded by copyright, trademark, and other intellectual property laws. You agree not to remove or infringe upon any copyright, trademark, or other proprietary notices found on this website or any material provided by Anveshan. Utilization of the Services does not grant you ownership rights to any intellectual property within the Services or the Material you access/download.
     

  2. All trademarks, service marks, and trade names of Anveshan or its partners, vendors, or licensors used herein (including, but not limited to, the Anveshan name and logo) (collectively "Identifiers") are trademarks or registered trademarks of Anveshan or its partners, vendors, or licensors. You are prohibited from using, copying, reproducing, republishing, uploading, posting, transmitting, distributing, or modifying the Identifiers in any manner, including in advertising or publicity related to distribution of materials on this website, without Anveshan's prior written consent.
     

  3. No portion of any materials provided by Anveshan on this website or otherwise may be reproduced, distributed, or transmitted in any form or by any means, including photocopying, recording, or other electronic or mechanical methods, without Anveshan's prior written permission. However, Clients who are educators may print and/or photocopy the materials (such as handouts) for the limited purpose of sharing them with their students, provided that such Clients shall not distribute the prints and/or photocopies to any other individual, including another Client, under any circumstances.

Prohibited Activities

While engaging with the Services, you shall refrain from:
a. Violating applicable laws; b. Participating in activities that may cause unjust loss or gain to any individual; c. Providing false or misleading information to Anveshan; d. Using or accessing any service, information, application, or software available for the Offerings in a manner not explicitly authorized by Anveshan.

Termination

Anveshan reserves the right, at its sole discretion, to terminate or suspend a Client's access to the Services, for any reason or no reason, upon notice to the Client. If you no longer wish to use the Services, you may notify Anveshan of your intention in writing at any time.

Payment

Anveshan hereby reserves the right to offer the Services for a fee under such terms as Anveshan deems appropriate.

No Academic Credit

Unless explicitly stated otherwise, participation in or completion of a course does not confer any academic credit on you (including any person accessing the Services through you).

No Enrolment

Utilizing the Services does not guarantee you (including any person accessing the Services through you) admission to or enrolment in any degree program offered by any institution. Furthermore, if you are accessing the Services through an Anveshan partnering institution, it does not obligate such institutions to maintain your enrolment as a student or to offer you a degree and/or certain level of grades.

Limitation of Liability

Your access and use of the offerings are at your own risk. To the maximum extent permitted by law, under no circumstances shall Anveshan, or any of its trustees, sponsors, officers, managers, members, employees, agents, or associated third parties be liable for any direct or indirect losses or damages arising from or in connection with your access or use of, or inability to access or use, the Services, or your reliance on any information provided by Anveshan in relation to the Services. This comprehensive limitation of liability applies to all losses and damages of any kind whatsoever, whether direct or indirect, general, special, incidental, consequential, exemplary or otherwise, including without limitation, loss of data, revenue, or profits. This limitation of liability applies whether the alleged liability is based on contract, negligence, tort, strict liability, or any other basis, and even if an authorized representative of Anveshan has been advised of, or should have known of, the possibility of such damages.

No Warranties

The website and/or offerings are provided to you on an "as is," "as available" basis, without warranties of any kind. To the fullest extent possible under applicable law, Anveshan disclaims all warranties, express, implied, or statutory, including, but not limited to, warranties of non-infringement. Without limiting the foregoing, Anveshan does not represent or warrant that the website and/or Services will be available at any particular time or location or that its operation will be uninterrupted or error-free. You acknowledge and agree that any access to or use of the website and/or Services is at your own risk. Anveshan cannot guarantee that content on the website and/or Services or elsewhere will be free of material you may find objectionable or otherwise inappropriate, or of malware or other contaminants that may harm your computer, mobile device, or any files therein. Anveshan disclaims any responsibility or liability related to your access or use of such third-party content.

Service Modifications

Anveshan retains the right to, at any time and in its sole discretion, cancel, delay, reschedule, or alter the format of the courses/modules offered, or to cease providing any part or all of the Services. You agree that Anveshan will not bear any liability to you for such actions.

Additional Terms

  1. Breach
    Without prejudice to your rights under the Terms, if you breach theTerms in any way, Anveshan may take such action as it deems appropriate to address the breach, including suspending your access to the Services, prohibiting you from accessing the Services, and/or initiating legal proceedings against you.

  2. Indemnification
    You agree to defend, hold harmless, and indemnify Anveshan and its trustees, sponsors, contributors, employees, officers, agents, and other Clients against any claims, actions, or demands arising from, resulting from, or in any way related to your use of the Services, including any liability or expense arising from any and all claims, losses, damages, suits, judgments, litigation costs, and attorneys' fees, of every kind and nature.

  3. Security
    While Anveshan will endeavor to protect the security of its Clients and their information in its possession, it cannot guarantee that unauthorized third parties will not be able to circumvent its security measures. Please notify Anveshan immediately of any compromise or unauthorized use of Client information by emailing anveshan@auroville.org.in.

  4. Variation
    The Terms may be modified by Anveshan at its sole discretion, and the modified terms will be displayed on this website.

  5. Waiver
    Anveshan's failure to exercise or enforce any right or provision of the Terms shall not constitute a waiver of such right or provision.

  6. Assignment
    Anveshan may transfer, sub-contract, or otherwise deal with its rights and/or obligations under the Terms without notifying you or obtaining your consent. You may not transfer, sub-contract, or otherwise deal with your rights and/or obligations under the Terms.

  7. Severability
    If a provision of the Terms is determined by any court or other competent authority to be unlawful and/or unenforceable, the other provisions will remain in effect. If any unlawful and/or unenforceable provision would be lawful or enforceable if part of it were deleted, that part will be deemed deleted, and the rest of the provision will continue in effect.

  8. Entire Agreement
    The Terms constitute the entire agreement between you and Anveshan and supersede all previous agreements between them with respect to the use of this website and/or the Services.

  9. Governing Law and Jurisdiction
    The Terms will be governed by and construed in accordance with the laws of India, and any disputes relating to the Terms will be subject to the exclusive jurisdiction of the courts of Chennai, Tamil Nadu.

  10. Changes to Terms and Conditions
    Anveshan reserves the right to update or modify these terms and conditions at any time without prior notice. It is your responsibility to review these terms periodically for changes.
